#RHOA: Kenya Moore Forced to Face Off With Ex Marc Daly in Court As He Demands She Be Found in Contempt
Real Housewives of Atlanta star Kenya Moore will be forced to see with her soon-to-be ex-husband Marc Daly after being ordered to try and hash out their differences privately, RadarOnline.com has learned.

The decision comes only weeks after Marc accused Kenya of breaching their custody deal in their nasty divorce.
According to court documents obtained by RadarOnline.com, the exes have been informed they are required to appear for an October 6 mediation. The judge noted that “The appearance and participation of all parties is required at the scheduled mediation session.”
However, Marc, who lives in New York, could appear via telephone if his lawyer appears in the Georgia court.

The judge said it appears “that in the interest of the parties” to try and resolve their issues by attending ANOTHER mediation. The past mediation ended with Marc accusing Kenya of refusing to execute a partial settlement they reached. She denied the deal was never finalized.

The two were supposed to have a trial in their divorce but it has been held up. The judge now wants them to try to mediate before the trial takes place.

As RadarOnline.com first reported, in July, Daly asked the court to find Moore in contempt of court for allegedly violating a court order when she allowed their 4-year-old daughter to be near a near-fight on RHOA. Moore has primary custody of their 4-year-old with Daly having visitation. As part of their previous custody battle, prior to the divorce, Daly tried to keep their daughter on the Bravo show.

Moore opposed the request claiming her contract for RHOA required her to share all aspects of her life on the show. The judge ended up siding with the reality star and ordered Brooklyn can appear on the show. He noted that there was no evidence that Moore would put their daughter in any inappropriate situations.

However, the judge did rule that “[Kenya] shall notify [Marc] of any opportunity where the minor child will appear on camera and shall advise [Marc] of the content of the appearance; the minor child will only be involved in opportunities that are age appropriate.”

Daly argued Moore let Brooklyn be near her co-star Marlo Hampton when she attempted to kick down Moore's hotel door. The child was sleeping inside the room when Hampton went off. The scene was featured on a recent episode of Real Housewives of Atlanta.

He also claimed Moore filmed a pizza commercial without informing him of the deal. In addition, Daly said that Moore refused to cooperate with “in-person” visits. He said he has only talked to Brooklyn twice in June despite his repeated requests for FaceTime calls.

Moore fired back at the allegations. She claimed to have notified her ex about the pizza ad. In regard to the Hampton incident, she said Brooklyn was asleep and was never aware of the incident.
She refuted Daly’s claim she was blocking him from communicating with their kid.

“Mother and Father had an established scheduled time daily to call the child. In an attempt to create issues, Father began to erratically change the times that he wanted to call on a whelm. He did this for the purpose of attempting to create an issue. Mother has implored Father to be consistent with his calls, which he refuses to do. Nevertheless, Father has been random in his behavior and unwilling to stick to the established schedule,” her motion read.

Moore accused Daly of having seen his child twice in two years. She said the two times he did was because she flew Brooklyn out to New York.
“In his failed attempt to have this Court and the public believe otherwise, the evidence will show that Father is simply a "FaceTime" Father, who is inconsistent with even talking to his child at best,” Moore’s motion read.

The case is ongoing.


#MusicNews: Mariah Carey Releases 'Music Box' 30th Anniversary Edition

Grammy-winning and best-selling female recording artist of all time Mariah Carey has dropped the 30th anniversary edition of her debut album, "Music Box."
The the new reissue includes unreleased tracks, mixes, live audio, and remastered audio with "My Prayer," "Hero (2009 Version)," "Anytime You Need A Friend (Extended Mix)," and "Music Box (Acapella)." A remastered version of "Mariah Carey Live at Proctor's Theatre" is also part of the release.

Carey will also release a mini documentary behind-the-scenes of "Dreamlover," which will also be released in 4k.

#HipHopNews: Common & Pete Rock Are Collaborating for An Album Dedicated to ‘90s Hip-Hop
Common is celebrating Hip-Hop 50 with one of the genre’s finest producers: Pete Rock. On a recent episode of MSNBC’s The Beat With Ari Melber, the Chicago rap legend surprised viewers with news that he’s collaborating with Rock for a forthcoming album.

“I been listening to a lot of ’90s hip-hop because I been creating a new project,” Common said. “I’m working on a new album with Pete Rock and just, the energy of that music, whether it’s Brand Nubian, A Tribe Called Quest, or De La Soul, because they just got their music on streaming, it’s been inspiring to hear.”
He added, “But I am creating new music right now. I’m in a great space.”

Common, who was also a rap guest during VP Kamala Harris’ hip-hop celebration last weekend, added that being a part of the genre’s 50th anniversary is “a part of the progression” and that the music “brings people together.”

Rock, known for his collaborations with legendary emcees like CL Smooth, Nas, and Camp Lo, has long worked with Common, including Ice Cube diss track “The B**** In Yoo.” Recently, Cube opened up to Chicago’s FakeShoreDrive about Common supporting him during his first show in the Windy City.

“Love Chicago. My first show — my first big show outside of L.A. was at the Regal Theater in Chicago,” Cube said. “We forgot our record. We forgot one of our records that we were performing. Guess who took me to the record store to buy the record? I had to go buy our own record. It was Common.”

He continued, “He was opening up for us. I mean, we didn’t really know who he was and you know that’s just ya know one of those footnotes. Chicago has always welcomed us before the rest of the country. It was Chicago.”
The beef between Cube and Common has long ended, but the latter has continued his streak in hip-hop. The artist’s fourteenth and latest album, A Beautiful Revolution Pt. 2, released in 2021.


Oprah Winfrey Feels 'Terrorized' With Criticisms Over Her Hawaii Relief Fund

Oprah Winfrey was shocked and saddened after she was "terrorized and vilified online" over her Hawaii relief fund. The TV titan teamed up with wrestler-turned-actor Dwayne "The Rock" Johnson to form the People's Fund of Maui to help those affected by the devastating wildfires in August that claimed 115 lives and destroyed homes and businesses across the island, with the pair donating $5 million each to get the organization started.

But Oprah has admitted she was surprised by the backlash she received from trolls who accused the wealthy star of hypocrisy by asking her less well-off followers to donate cash. During an interview on "CBS Mornings", she cited her new book about happiness and said of the trolling, "Well, this is a really great point about being happier in the midst of an onslaught of being terrorired and vilified online. I will say this. I came out of this experience with so much more compassion for young kids, because I was thinking, what if I didn't really know who I am? It will take you out. So all of the online attacks, lies, conspiracy theories, really took the focus off of what was the most important thing, which is the people of Maui."

Oprah, who has a home on Maui, explained the idea for the fund came from previous charity efforts by singer Dolly Parton, who raised millions to help victims of the 2017 wildfires which devastated the city of Gatlinburg, Tennessee and made sure the money went straight into the hands of those who needed it.

She added, "We [Dwayne and I] thought, because both of us have given to charities our whole lives, that starting the fund with $10 million would be a great idea. We'll do what Dolly did, get other people to give money and then we'll put it directly into people's bank accounts. I was so excited. I was so excited about it, and then I got up the next morning, and I saw all of this vitriol, and I was, like: 'Whoa, what happened here?' This is what I want to say. I want to say that, in the beginning, so many people were calling, asking: 'Where do we give our money to?' So I thought, I'm going to give people a place to give it. We're going to create something and I still think it's a really strong idea."

She continued, "Dolly Parton was right. Putting money directly in the hands of the people is a significant thing, and the model that has been created, I will say that as of today, 2,200 people have been cleared and verified, and those people are gonna get a notice from the People's Fund of Maui and are gonna have the money put into their account."

She concluded that the backlash over the fund made her feel "sad that we're in this state in our country."


Paris Jackson’s Stalker Faces A Year In Jail After Being Criminally Charged
An obsessed fan of Michael Jackson's daughter is facing jail time after being charged with several crimes associated with stalking Paris Jackson.
According to new legal documents, obtained by The Blast, the person (who we are choosing not to name) has been charged with four misdemeanors including two for "stalking."

The person is facing a "loitering to commit a crime" charge along with another one for "harassment on social media." If convicted, he faces up to a year in County Jail for each of the charges, and up to a $1000 fine.
Specifically, the law states that "any person who willfully, maliciously, and repeatedly follows or willfully and maliciously harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family is guilty of the crime of stalking."

As we reported, Paris Jackon filed a restraining order against the man after he allegedly scaled her fence. At the time, Paris wasn't some, but the documents say the man climbed the fence and "looked through her windows." A friend of the famous offspring chased him off and called the police.

The person was eventually arrested and charged with the four crimes. At this point, he is currently locked up in Los Angeles' Men Central Jail -- being held on $20,000 bail.
In the restraining order filing, Paris is clear she does not know this person. She explains that the man reportedly started messaging her in late 2019, and she's concerned the behavior of trying to contact her is escalating. Two days after the peeping windows incident, authorities say they took a police report of another man who approached her front door. Again, she was not home at the time.

In this situation, the person's criminal case might land them in jail, but that doesn't keep him away from Paris Jackson after being released. So, she filed a civil restraining order that can be ordered for up to five years to keep him away from her home. It is now up to a judge.

Paris has had an interesting month, including an issue with her father's die-hard fans for not celebrating his birthday. The King of Pop, who died in 2009, would have been 65 years old.

"They’re basically measuring my love for my own father based on what I post on Instagram,” she said. Adding, "If you are an MJ super fan and you want to do something that he would have loved, which is not celebrate his birthday, my suggestion would be there are always ways to get involved with raising awareness for climate change, doing stuff for the environment, animal rights activism. These are things that he loved and was really interested in."

The man is due back in court on September 20, 2023, to face the charges.


Sean Penn Says Will Smith's Slap Made Him Want to Melt His 2 Oscars Into Bullets for Ukraine

Every now and again, comes a celebrity cover story that lifts the veil ever so slightly to reveal that—surprise!—a Hollywood elite really is just like us. Or—blessedly—they’re not. Such is the case for a new Variety profile wherein global humanitarian Sean Penn not only lifts the veil but stomps on it, sets it ablaze, then hurls its charred remains into the ocean only to fish it back out again because, you know, pollution.

The interview boasts as many twists and turns as O. Henry and partly takes place across Penn’s coffee table which the writer notes is curiously littered with sunglasses, prescription bottles, and some sort of device that shoots salt at mosquitoes. The actor takes aim at everyone—from Will Smith to al-Qaeda to AI—at seemingly every possible opportunity throughout the conversation.

First, Penn notes the Academy of Motion Picture Arts and Sciences’s refusal to allow the president of Ukraine, Volodymyr Zelenskyy, to speak at the 2022 Oscars, weeks after Ukraine was invaded by Russia. “The Oscars producer thought, ‘Oh, he’s not light-hearted enough.’ Well, guess what you got instead? Will Smith!” The author observes that Penn’s face immediately reddened at the subject and one of his neck veins “tightens like a rope pulled taut.”

Smith is “nice,” Penn said, noting that he’s only met him one time but still proceeds to light up an American Spirit and drag him to hell for slapping Chris Rock. “So why the fuck did you just spit on yourself and everybody else with this stupid fucking thing? Why did I go to fucking jail for what you just did? And you’re still sitting there?” Penn rambles. “Why are you guys standing and applauding his worst moment as a person?”

Apparently, of all of the depravity happening in Hollywood, Penn is still ranting and raving about the fact that his pal Zelenskyy couldn’t pander to a room full of millionaires.
“This fucking bullshit wouldn’t have happened with Zelenskyy,” Penn insisted. “Will Smith would never have left that chair to be part of stupid violence. It never would have happened.” Somehow, Penn’s rage on the matter becomes more ridiculous.

The slap made him consider his Oscar trophies, he told Variety: “I thought, well, fuck, you know? I’ll give them to Ukraine. They can be melted down to bullets they can shoot at the Russians.” Now I know I’m no expert here, but how many bullets can be produced from two trophies???

Then, the conversation naturally turns to 9/11. If Penn were president, he hypothesized, the United States’ response would’ve been different. If that sounds like a vaguely normal statement, just you wait: “I’d have let White House counsel know that they are on vacation,” Penn began. “I’m not consulting with them. If I have to go to prison, I’ll go, but I’m going to kill them. I’m killing everyone that did this. But only them. And we know where the fuck they are.” This folks, is precisely why a Leo (Penn’s birthday is August 17) should never be put in charge of a country.

And to be sure he hit all the hot buttons, Penn also shared his thoughts on AI use in Hollywood and the best way to level with studio executives. His plan, as he lays out to Variety, begins by entering a boardroom of studio heads with a camera crew in tow.

“So you want my scans and voice data and all that,” Penn imagines saying. “OK, here’s what I think is fair: I want your daughter’s, because I want to create a virtual replica of her and invite my friends over to do whatever we want in a virtual party right now. Would you please look at the camera and tell me you think that’s cool?” Are you reading this, WGA and SAG-AFTRA??? Give that a go for the next bargaining sesh!

Penn softens significantly when asked about his bond with Zelenskyy though. Apparently, the two met in February 2022, just as Russian troops invaded Ukraine. At the time, the writer notes, Zelenskyy’s country was newly “on the precipice of annexation.” Even still, he took a meeting from his bunker with none other than Penn, who was there filming a documentary.
“It blew my mind he kept the meeting,” Penn recalled, specifically mentioning Zelenskyy’s demeanor as the ongoing horrors in Ukraine began. “His brain is fully oxygenated. His eyes are clear and he’s warm. I knew I’m either going to feel nothing or I’m going to let myself love him.” OK!

Ultimately, Penn has decided not to melt his Academy Awards. Instead, he bestowed one upon Zelenskyy. “I told him to keep it and bring it to Malibu after all this is over and his country is safe.” Who doesn’t love a happy Hollywood ending!?


Justin Roiland Denies New Report Alleging Sexual Assault and Messages With Young Fans
After being cleared of domestic violence charges in March, Justin Roiland is the subject of a new report from NBC News based on interviews with 11 women and nonbinary people who messaged with the “Rick and Morty” co-creator over text, email and social media between 2013 and 2022. Nine of the interviewees allege that Roiland shifted their conversations to be of a sexual nature, with three saying they were 16 years old when they began their correspondences. Along with giving interviews, the 11 sources in the report provided NBC News with photos, videos, social media posts, emails and receipts that point towards their involvements with Roiland.

These new allegations are separate from the charges against Roiland that were dropped earlier this year, which pertained to allegations of battery and false imprisonment made by an unnamed Jane Doe who was dating Roiland in January 2020 at the time of the claimed incident.
When asked for comment on the allegations made in Wednesday’s report, Roiland’s lawyer Andrew Brettler directed Variety towards a statement Roiland posted on X, then known as Twitter, in March after the domestic violence charges were dropped. Brettler declined to provide a further response to the newer allegations, though NBC News reported that he wrote the outlet a letter calling the allegations “false and defamatory.”

Among the allegations was an incident of forced oral sex with a 20-year-old woman. The woman alleged that, after exchanging messages on Tinder in March 2019, Roiland bought her two alcoholic beverages despite that she had already told him she was underage, before asking her to perform oral sex on him. When she said no, the woman says, Roiland pushed her head towards his crotch and she stopped resisting. She says that she related the events to a friend over the phone immediately afterwards, which NBC News verified with the friend.

Text messages from four months later appear to show the woman confronting Roiland, saying that the sexual encounter was “not handled by [Roiland] in the best way” and that “it was not black and white but verbal consent is [very] important.” Roiland’s reponse reads, “Shit yeah, I didn’t?? I’m really sorry! Fuck. That’s not cool at all — jeeeesus. That is not me whatsoever… I literally didn’t get consent??”

Another woman described correspondence with Roiland that began in May 2016, when she was 19 and Roiland was 36. Roiland followed her on X and began messaging her about her artwork. The two continued to converse over time, eventually exchanging phone numbers, and in March 2017, Roiland offered to pay for her to fly to Los Angeles to visit him. She agreed, though her father required that Roiland speak with him over FaceTime beforehand. After the call, Roiland texted the woman that he understood her parents’ concern and said, “I will make absolute 100% sure nothing bad happens to you.”

Before that call, their text messages had already shifted to a sexual nature, with Roiland asking the woman about her sexual orientation, as messages with other interviewees show he often inquired about. Though the woman reciprocated Roiland’s flirting, she indicated that she didn’t think she was interested in women.

Upon her arrival in Los Angeles, the woman says that a party at Roiland’s house ended with her alone in a hot tub with Roiland and a female friend of his. She says that she remembers drinking liquor and has forgotten parts of the night, but remembers performing sexual acts with Roiland’s friend in front of Roiland upon his request, and that Roiland had sex with her in front of his friend. Later that night, Roiland asked the woman via text message if she was okay, and she expressed her discomfort with group sex and said that she felt “terrible.” Roiland said they didn’t have to do that again and that he wanted to sleep with her that night. Having fallen asleep, the woman didn’t respond, and Roiland then sent several erroneous messages including one iPhone sticker 14 times, depicting a man with several penises in his mouth. The next day, the woman says she consented to having sex with Roiland but felt pressured to allow him to film them, and that she worries he still has the video.

Brettler told NBC News that the woman had had consexual sex with Roiland in the hours leading up to the hot tub incident, which the woman told NBC News she doesn’t remember. Brettler also said that Roiland was not responsible for her sexual encounter with the other woman in the hot tub.

The report also notes messages where Roiland referred to two different people as “jailbait” due to their being 16 years old, and a message where a 16-year-old girl expressed interest in livestreaming as a video gamer, to which Roiland responded, “Then once you turn 18 you just start cam whoring.” Another woman said that Roiland told her she would like his girlfriend if she was “into girls.” One person said they attended a party with Roiland where he offered them alcohol despite that they were underage and reluctant to drink, and that they left after Roiland asked them to kiss a woman he had invited.

Seven of the interviewees had posted some of their messages with Roiland on social media before, while four had not. NBC News said that “most” of the interviewees shared their encounters with Roiland after realizing that other people had had similar experiences.


Ciara Shares Simple but Pointed Response to Question About Co-Parenting with Ex Future

Ciara made a simple but telling statement about the relationship she shares with ex Future.
The 37-year-old “Goodies” hitmaker split from the 39-year-old rapper in 2014, three months after they welcomed their son Future Jr.

She has since moved on and tied the knot with Russell Wilson. They got married in 2016.
During a recent interview, Ciara was asked about how she and Future split parenting responsibilities. Her response is going viral.

While speaking to The Shade Room, Ciara laughed for 30 seconds straight when asked about co-parenting. “You’re awesome,” she said to the reporter while chuckling. Their response: “That says it all.”
“Ciara when asked about coparenting! When I tell you I am in complete TEARS!!!!!!!! 😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂,” a fan wrote on Twitter

Earlier this summer, Future seemingly reignited a feud with Russell by taking aim at him on a new song. The rapper had previously been critical of their relationship.

Russell simply responded to the drama by sharing a new photo of himself spending time with Future Jr.
A few years ago Ciara explained why she ended her relationship with Future.
She and Russell are currently expecting their third child together. They share daughter Sienna and son Win.


Eddie Murphy’s Son Weds Girlfriend in Beverly Hills
*Eddie Murphy‘s son, Myles Murphy, wed his girlfriend in Beverly Hills on Saturday.
Myles, 30, and Carly Fink, 32, tied the knot in a private ceremony, People reports. The couple are parents to four-year-old daughter Evie, who recently started early kindergarten.

Myles’ mother, Nicole Murphy, shared on Instagram highlights from the ceremony. “Congratulations to my son Myles & now his beautiful wife Carly. The wedding was stunning. Proud of you two,” she captioned the post. “One big happy family.”
In November 2022, Carly hit up IG to share a tribute to Myles on his 30th birthday. “30. Myles, the love Evie & I have for you is infinite! I am SO proud of you always,” she wrote. “God will continue to bless you & our whole family with health, happiness, success & blessings. I love you my FIANCÉ & I can’t wait to marry you.❤️ HAPPY BIRTHDAY BABY!”

Among Murphy’s ten children, Myles is one of five he shares with Nicole. According to People, the former couple met in 1988 and wed in 1993. They called it quits in 2006.

Last year, Carly shared a video on social media of Myles’ proposal.
“Forever my love🥹❤️💍,” she wrote in the post’s caption, Yahoo reports.


Jonathan Majors Breaks Up Teen Fight While Out For Lunch

Jonathan Majors is using his free time for good, having intervened during a brawl between two girls.
On Monday, the “Creed 3” star was grabbing lunch at an In-N-Out restaurant across the street from Hollywood High School. While retrieving his food, he noticed two teenage girls throwing punches at one another on the school grounds as a group of other students gathered around, some of whom were recording with their phones. Majors took matters into his own hands, stepping in between the girls. They continued trying to get at one another as the actor pleaded with them to walk away from the altercation. Eventually, the girls were able to bypass him and continue their beatdown before Majors was able to get the situation under control again and end the violence for good.

Hours after using his muscles for good, TMZ caught up with Majors, who said he didn’t know either girl during the “schoolyard fight.” Still, he hoped that both were okay following their mid-day scrabble. This unexpected sequence of events is the first good press for Majors in months, who continues to face charges for his own alleged brutality. The 34-year-old is accused of attacking his ex-girlfriend, Grace Jabbari, in New York City. He has maintained his innocence, even accusing Jabbari of being the aggressor. Majors has pleaded not guilty and is due back in court on Friday.

No school staff ever intervened during the brawl, and it’s unclear if Hollywood High is aware of the situation.


New Lawsuit Claims Kanye West Wanted To Convert His $57M Malibu Home Into “Bomb Shelter” To “Hide from the Clintons and Kardashians”
Kanye West is facing a new lawsuit that claims he wanted to turn his $57 million Malibu mansion into a windowless, plumbing- and electricity-free “bomb shelter.”
A 40-page lawsuit was filed in Los Angeles Superior Court by Ye’s former project manager and property caretaker, Tony Saxon, who claims he wasn’t paid for his work on the home in the fall of 2021 and that he was fired due to a back injury.

According to Saxon, Kanye wanted to replace the home’s electricity with large generators. However, when Saxon expressed fire hazard concerns, Ye reportedly “raised his voice” and told Saxon “he would be considered an enemy if he did not comply” before ordering him to “get the hell out.”

Saxon further claimed that Ye wanted “a bomb shelter from the 1910s.” He said he was tasked with building him a “Bat Cave” so he could “hide from the Clintons and Kardashians.”
He said, “Ye wanted no electricity. He only wanted plants, candles, battery lights; and to have everything open and dark. You can’t keep food in that house, because you had no refrigerator left. You had no windows. I had seagulls flying in.”

“He wants to be on a privatized Wi-Fi network,” Saxon said, adding, “He wants to have an alternate source of energy. He wants to have no doors, no windows, no fixtures, just concrete.”
Saxon has enlisted the same attorneys who are suing Kanye West over safety concerns at his private Christian school, Donda Academy.


Megan Thee Stallion Will be in the New ‘Big Mouth’ for Season 7

Big Mouth is getting the Hot Girl treatment. The animated Nick Kroll show Big Mouth returns to Netflix for its seventh season next month, and a new trailer was released on Thursday (Sept. 14) featuring none other than Megan Thee Stallion as a hormone monstress. “It’s a big motherf—ing deal that they got me on the show,” her voluptuous character says in the 47-second teaser, before she breaks into a twerk.

Alongside series regulars Kroll, John Mulaney, Maya Rudolph and Fred Armisen, the upcoming season will feature a slew of guest stars in addition to the “Savage” rapper, including Lupita Nyong’o, Zazie Beetz, Randall Park, Chloe Fineman, Zach Galifianakis, Mark Duplass, Brian Tyree Henry and more.

Hunter Biden indicted on federal gun charges
The indictment against the president's son comes after a plea agreement on tax and gun charges fell apart in July and amid a probe of his finances by House Republicans.
Federal prosecutors have indicted Hunter Biden, son of President Joe Biden, on gun charges, court documents show.

Biden was indicted Thursday in Delaware federal court on three counts tied to the possession of a gun while using narcotics.
Two counts are tied to Biden allegedly completing a form indicating he was not using illegal drugs when he purchased a Colt Cobra revolver in October 2018. The third count alleges that he possessed a firearm while using a narcotic. The indictment says Biden certified on a federally mandated form "that he was not an unlawful user of, and addicted to, any stimulant, narcotic drug, and any other controlled substance, when in fact, as he knew, that statement was false and fictitious.”

Two of the counts carry a maximum prison sentence of 10 years, while the third has a maximum of five years. Each count also carries a maximum fine of $250,000.
The historic indictment against the son of a sitting president comes after a plea deal that might have ended a yearslong probe into Hunter Biden fell apart and just as House Republicans have launched an impeachment inquiry in an effort to seek bank records and other documents from the president and his son.

The case is being overseen by special counsel David Weiss, who also headed the investigation. Weiss is a Trump appointee who was kept on as U.S. attorney for Delaware because of the sensitive and unique nature of the investigation into a president's son by the Justice Department, a part of the executive branch headed by the president. U.S. Attorney General Merrick Garland named Weiss special counsel in August, as negotiations over the tax and gun charges collapsed.

The White House referred requests for comment to the Justice Department and Hunter Biden's legal team.
Weis declined to comment on the investigation when approached by NBC News on Thursday before the indictment was unsealed.

An attorney for Hunter Biden, Abbe Lowell, said in a statement that the new charges are politically influenced and unwarranted. "We believe these charges are barred by the agreement the prosecutors made with Mr. Biden, the recent rulings by several federal courts that this statute is unconstitutional, and the facts that he did not violate that law, and we plan to demonstrate all of that in court,” Lowell said.

Weiss’s investigation was opened in 2018, the year before Joe Biden announced his candidacy for president, according to a source familiar with the inquiry, and focused on the younger Biden’s finances.
The two sides reached a plea agreement in July that called for Hunter Biden to plead guilty in Delaware federal court to two misdemeanor counts of failing to pay his taxes in return for prosecutors recommending a sentence of probation. A separate felony gun charge for illegally owning the Colt Cobra .38 Special handgun would have been dropped in two years if Biden honored the terms of what’s known as a diversion agreement.

The plea agreement started to fall apart at the court appearance where it was expected to be finalized after the judge presiding over the case raised questions about some details. “The agreements are not straightforward and they contain some atypical provisions,” U.S. District Judge Maryellen Noreika noted, including one that could theoretically protect Biden from other tax-related crimes in the same time period.

Prosecutors said the provision in the diversion agreement would not protect him from different charges, while attorneys for Hunter Biden said it would. Noreika, a Trump-appointed judge, asked both sides for more information, and the agreement — which Republicans were already blasting as a “sweetheart deal” — subsequently fell apart.

In subsequent court filings, Weiss’s office noted that without the plea agreement in place, there were venue issues and the tax case would most likely have to go to trial in California or Washington, D.C. Prosecutors also suggested that they might bring different charges in the new case. In a court filing last week, prosecutors indicated new indictments would be filed before the end of the month. Asked Thursday if any additional charges or indictments would be coming, a spokesperson for the special counsel said "the investigation continues."

Two of the charges filed Thursday were not used in the prosecutors' gun case in July, which Lowell made note of in his statement. He said "prosecutors filed charges today that they deemed were not warranted just six weeks ago following a five-year investigation into this case. The evidence in this matter has not changed in the last six weeks, but the law has and so has MAGA Republicans’ improper and partisan interference in this process. Hunter Biden possessing an unloaded gun for 11 days was not a threat to public safety, but a prosecutor, with all the power imaginable, bending to political pressure presents a grave threat to our system of justice "

Lowell has also argued the diversion agreement in the previous gun case is still in effect because it had already been signed by his client and prosecutors and said it “prevents any additional charges from being filed against Mr. Biden.”
Prosecutors dispute that the agreement is in effect, arguing it lacks a necessary signature from the probation department.

Attachments to the plea agreement and the diversion agreement that were filed in court in July and cannot be used in the current case blamed Biden’s conduct in the tax and gun cases on his drug and alcohol addiction. The documents say that he got sober in May 2019, and with the help of a third-party paid off about $2 million in back taxes and penalties by October of 2021.

A “statement of facts” document included in the original gun case said that Biden was using crack cocaine during the period when he bought a revolver from a federally licensed firearms dealer in Delaware in October of 2018. Filling out a federally mandated form asking if he used illegal narcotics, “Biden answered ‘no,’ even though he was a user of and addicted to crack cocaine at the time,” the court filing said.

He wound up possessing the gun for 11 days, and during that time “he purchased and used crack cocaine regularly,” the filing continued. The gun was later found in his car along with drug paraphernalia, and was “subsequently discarded in a trashcan outside a supermarket in Greenville, Delaware.”
House Oversight Committee chair James Comer, R-Ky., who has been investigating the Biden family finances but made no criminal referrals, said he was unimpressed with the new charges, calling it "the least of all the dozen crimes he’s committed." "I’m still holding out hope that Weiss does the right thing" and pursues additional charges against the president's son.

Former President Donald Trump also complained about the charges on his social media platform Truth Social, saying it was "the only crime that Hunter Biden committed that does not implicate Crooked Joe Biden."

The House probes have focused on money Hunter Biden made from foreign sources while his father was vice president, but have not turned up any evidence to date that the president benefitted from his son's business dealings.
The White House has been largely silent on the investigation, but the president defended his son in an interview with MSNBC’s Stephanie Ruhle on May 5.

“First of all, my son has done nothing wrong,” the president said. “I trust him. I have faith in him.”
Asked by Ruhle how charges against his son would affect his presidency, Biden said, “It impacts my presidency by making me feel proud of him.”

Hunter Biden told CBS News in a 2021 interview that he was “cooperating completely” with the federal probe. “And I’m absolutely certain, 100 percent certain,” he said, “that at the end of the investigation, I will be cleared of any wrongdoing.”
